3 - Le pastoralisme transfrontalier et le droit à la nationalité : quelles perspectives en Afrique de l'Ouest ?

Résumé
La question du droit à la nationalité, décrit pat Hannah Arendt comme « le droit d’avoir des droits », comme celle de l’éradication de l’apatridie, reste une préoccupation internationale. Des conventions ont été adoptées au niveau mondial à cet effet. Néanmoins, un problème spécifique se pose en Afrique, avec tant d’acuité qu’il nécessite « un regard africain » : le pastoralisme transfrontalier en lien avec le droit à la nationalité. Le pastoralisme nomade ou l’élevage transhumant représente un mode de vie et des moyens de subsistance pour des millions de personnes en Afrique de l’Ouest. Il réunit en grande partie plusieurs groupes ethniques historiquement liés au pastoralisme, en particulier les Touaregs (Berbères/Amazigh) et les Peuls, y compris les sous-groupes peuls tels que les Mborobo. Bien que certains éleveurs soient sédentaires, semi sédentaires, ou ne se déplacent qu’entre deux pôles de migration en fonction des saisons (transhumance), d’autres n’ont pas de lieu fixe et se déplacent librement sur le long terme, en fonction de variations climatiques et d’autres priorités. Les tentatives visant à encourager les éleveurs nomades à s’établir ou à se soumettre à l’autorité d’une organisation politique centralisée ont créé des tensions au cours des périodes coloniales et postcoloniales. Cet article vise à analyser le cadre juridique applicable aux groupes pastoraux afin de protèger leur droit fondamental à la nationalité en contexte de mobilité permanente.
